1. Acceptance of Terms

By creating an account, logging in via OAuth (e.g., Google), or using any part of our Platform, you agree to these Terms of Service and our Privacy Policy. If you are using our Platform on behalf of an organization (such as a school, company, or institution running a Thapaye awareness program), you represent that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years old (or the minimum age required by law in your country) to use our services. If you are under 18, you may only use the Platform with the consent of a parent, guardian, or an authorized institution (such as your school) deploying Thapaye as part of an educational program. By using our Platform, you confirm that you meet this age requirement and that all information you provide is accurate.

3. Nature of the Platform — Educational Simulation Only

Thapaye is a gamified educational tool designed to raise awareness about cyber crime and common scam tactics (such as vishing, OTP fraud, gaming scams, and identity theft) targeting Nepali digital platforms.

• All scam scenarios, simulated messages, fake payment prompts, and “attacker” content within the Platform are fictional and for educational purposes only.
• Thapaye will never ask you for your real banking details, OTPs, PINs, passwords, or other sensitive credentials. Any such request claiming to be from Thapaye is fraudulent and should be reported to us immediately.
• References to third-party platforms (such as eSewa or Khalti) within simulations are used solely to illustrate real-world scam patterns and do not imply any partnership, endorsement, or real transaction with those platforms.
• Completing modules, quizzes, or challenges on Thapaye does not constitute professional legal, financial, or cybersecurity advice.

4. Accounts & Login

You may log in using third-party services such as Google via OAuth. You are responsible for maintaining the confidentiality of your account credentials and ensuring no unauthorized access occurs. Notify us immediately if you suspect unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate our policies.

5. Use of the Platform

You agree to use Thapaye only for lawful purposes and in compliance with applicable laws and regulations.

You agree not to:

• Use the Platform for any illegal, harmful, or fraudulent activity.
• Use scam scenarios, techniques, or content learned on the Platform to actually deceive, defraud, or harm others.
• Interfere with the operation or security of the Platform.
• Reverse engineer, modify, or copy our source code, game logic, or systems.
• Use bots, scrapers, or automated tools to extract data or manipulate leaderboard rankings.
• Violate the rights or privacy of other users, including harassment related to leaderboard rankings or public profiles.

We reserve the right to restrict, suspend, or terminate your access at any time if we believe you violated these Terms — including any use of the Platform’s scam-simulation content for real-world harm.

6. Gamification, Leaderboards & Rewards

• Points, badges, ranks, and leaderboard positions have no monetary value and cannot be exchanged, transferred, or redeemed for cash or goods unless explicitly stated in a specific program or partnership.
• We may reset, adjust, or remove leaderboard data, scores, or rewards at our discretion, including to correct errors or address suspected manipulation.
• If you participate in leaderboards, your display name and score may be visible to other users, in accordance with our Privacy Policy.

7. Intellectual Property

All content, trademarks, logos, graphics, quiz questions, scam simulations, and software on the Platform are owned or licensed by Thapaye. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.

You retain ownership of any content you submit to the Platform (such as scam reports or feedback), but by doing so, you grant us a non-exclusive, worldwide, royalty-free license to use that content for the purpose of operating, improving, and promoting the service — including using anonymized or aggregated scam-report data to improve awareness content.

8. Third-Party Services

Our Platform may integrate with third-party services (e.g., Google OAuth, analytics, cloud providers). Your use of such services is subject to their respective terms and privacy policies. We are not responsible for the actions, content, or policies of third parties.

9. Data & Privacy

We collect and process personal information in accordance with our Privacy Policy. By using the Platform, you consent to such collection and processing.

10. Termination

You may stop using our Platform at any time. We may suspend or terminate your account if:

• You violate these Terms or applicable laws.
• You engage in fraudulent, abusive, or harmful activities — including misusing scam-simulation techniques against real people.
• Required by legal or regulatory obligations.

Upon termination, your access will be disabled, and data may be deleted as described in our Privacy Policy.

11. Disclaimer of Warranties

Our Platform is provided “as is” and “as available” without warranties of any kind. We do not guarantee:

• Continuous or error-free operation;
• That data will always be accurate, complete, or secure;
• That completing our awareness modules will prevent you from becoming a victim of an actual scam;
• That the Platform will meet your specific expectations.

You use the Platform at your own risk, and Thapaye is a supplementary awareness tool, not a substitute for exercising your own caution online.

12. Limitation of Liability

To the maximum extent permitted by law, Thapaye and its affiliates shall not be liable for:

• Any indirect, incidental, or consequential damages;
• Loss of data, revenue, or profits;
• Any real-world financial loss or scam you experience outside the Platform, regardless of whether you completed our awareness training;
• Damages resulting from unauthorized access or use of your account or information.

In any case, our total liability shall not exceed the amount (if any) you paid for using our service during the 12 months prior to the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless Thapaye, its affiliates, and employees from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of:

• Your use or misuse of the Platform;
• Your violation of these Terms or applicable laws;
• Your infringement of any third-party rights;
• Any harm caused by your use of scam techniques or content from the Platform against a third party.

14. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify you via email or a notice on our website. Your continued use of the Platform after updates constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Nepal, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the competent courts of Kathmandu, Nepal.
